By booking a tour, registering for a group expedition, or renting a motorcycle with Ladakh Bikers (Aryan Ladakh Tour & Travel), you explicitly agree to the following terms. Please read them carefully — they constitute a binding legal agreement between you and our registered business entity.
1. Parties to This Agreement
This agreement is entered into between the customer ("Rider" / "Client") and Aryan Ladakh Tour & Travel, operating commercially under the brand name Ladakh Bikers, with its principal place of business at Karzu Rd, Leh, Ladakh — 194101, India. All services, bookings, permits, and rental agreements are legally provided by Aryan Ladakh Tour & Travel.
2. Booking, Payments & Tariffs
A non-refundable booking advance is required to reserve a slot on our guided tours or to reserve a rental motorcycle. The remaining balance must be cleared in full prior to the physical handover of keys or the start of the expedition. Prices quoted on our website or WhatsApp are indicative and subject to revision due to changes in government taxes, permit charges, fuel costs, or union-imposed surcharges without prior notice.
3. Security Deposits & Damage Liability
Upon delivery of any rental motorcycle, the rider must pay a refundable security deposit (cash, UPI, or international bank transfer). This deposit covers minor crash damage, missing accessories, or mechanical issues resulting from rider negligence. If a motorcycle suffers major damage rendering it unrideable, the rider is responsible for:
- The full cost of genuine spare parts and authorised workshop labour.
- Transport and towing charges to return the motorcycle to our Leh base camp.
- Loss of rental revenue for the days the motorcycle remains grounded in our workshop.
The security deposit is returned in full upon check-in inspection, provided the motorcycle is returned in the same mechanical and cosmetic condition as at handover.
4. Accident Liability & Indemnity Waiver
CRITICAL WAIVER: Motorcycle touring in high-altitude terrain, riverbeds, gravel tracks, and mountain passes (including Khardung La, Chang La, Tanglang La, and Umling La) carries inherent risk of serious injury, permanent disability, or death. By signing our booking confirmation or rental agreement, the rider declares that they participate voluntarily and fully assume all associated risks. Aryan Ladakh Tour & Travel (Ladakh Bikers), its guides, mechanics, marshals, and management shall not be held liable for any physical injury, illness, loss of life, or property damage during the course of any tour or rental period.
5. Medical Fitness, Altitude & Acclimatisation Mandate
High-altitude regions above 3,500 metres exert extreme physiological stress. Acute Mountain Sickness (AMS) can rapidly progress to High-Altitude Pulmonary Oedema (HAPE) or High-Altitude Cerebral Oedema (HACE). Riders agree to the following:
- Mandatory Rest: A minimum of 36–48 hours of physical rest in Leh town is required for all fly-in tourists before attempting passes above 4,000 metres.
- Medical Declaration: Riders must disclose any history of asthma, heart disease, high blood pressure, or respiratory illness before booking. Concealment of a pre-existing condition voids all liability for Aryan Ladakh Tour & Travel.
- Safety Evacuation: If our tour captain or medical officer determines a rider's SpO₂ has dropped to unsafe levels, the rider must comply with descent instructions immediately. Emergency transport, hospital, and helicopter evacuation costs are entirely the rider's responsibility.
6. Rider Conduct & Group Convoy Rules
Group departures operate under strict convoy protocols for the safety of all participants. Riders must follow directions from the Lead Tour Captain and Ride Marshal at all times:
- Zero Tolerance for Alcohol/Drugs: Riding under the influence of alcohol, cannabis, or any controlled substance is strictly prohibited and results in immediate expulsion, cancellation of rental, and forfeiture of all payments.
- Convoy Discipline: Overtaking the lead rider, reckless riding, drifting, or leaving the designated route without authorisation is prohibited.
- Documentation: The rider must carry a valid, physical motorcycle driving licence (LMV/MCWG endorsement) at all checkpoints. International riders must carry a valid Passport, Indian Tourist Visa, and International Driving Permit (IDP) at all times.
7. Force Majeure & Route Alterations
Ladakh's terrain is highly volatile. Landslides, cloudbursts, early-winter snow, military road closures, or refusal of Inner Line or Protected Area Permits by border authorities are entirely outside our control. In the event of a Force Majeure situation:
- Aryan Ladakh Tour & Travel reserves the right to modify the itinerary, rearrange routes, or change accommodations without liability.
- No refunds or compensation will be issued for destinations rendered inaccessible by army closure, weather, or border tension (e.g., Umling La, Pangong Lake).
- Any additional boarding, lodging, or transport expenses arising from road blockades are the rider's sole responsibility.
8. Legal Union Restrictions (LA-02 Cooperative Rules)
Riders agree to comply with Ladakh Bike Rental Cooperative Union regulations. Motorcycles registered or rented outside Ladakh (Delhi/HP/other state plates) are legally barred from commercial sightseeing in Ladakh's permit zones. Aryan Ladakh Tour & Travel is not responsible if outside-registered rental motorcycles are seized by local unions or police checkpoints.
9. International Rider Special Conditions
For riders holding a foreign passport, the following additional conditions apply:
- Protected Area Permits (PAP): Foreign nationals require a PAP for areas including Nubra Valley, Pangong Tso, Hanle, and Umling La. Aryan Ladakh Tour & Travel will process these on your behalf upon receipt of passport and visa copies. Permit denial by authorities is outside our control and does not entitle the client to a refund.
- International Driving Permit: Riders must hold a valid IDP with motorcycle endorsement. Riding without a valid IDP is illegal under Indian Motor Vehicles Act and voids all liability held by Aryan Ladakh Tour & Travel.
- Travel Insurance: Riders are required to carry personal travel insurance explicitly covering high-altitude motorcycling (above 4,000 metres) and emergency medical evacuation. Ladakh Bikers does not provide insurance of any kind.
- Payment Terms: International deposits are accepted via Wise, SWIFT bank transfer, or international Visa/MasterCard. All quoted prices are in INR. Exchange rate fluctuations are the client's responsibility.
10. Governing Law & Jurisdiction
This agreement is governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Leh, Ladakh (UT), India. International clients agree to submit to this jurisdiction and waive any right to proceedings in their home country courts.
